STEP 1: OBTAINING A "NON-IMMIGRANT VISA"

However, before you apply a work permit, you must first have a valid Non-Immigrant visa. This is an important requirement for applying work permit. It can be acquired prior to your arrival in Thailand. Our licensed lawyers can assist you in obtaining the visa at the Royal Thai Embassy or Thai Consulate in your home country or other countries nearby Thailand. Moreover, we can help to convert a Tourist Visa to Non-Immigrant visa in Thailand, but the process will take approximately one to two (1-2) months for consideration by the Immigration Bureau.

Requirements for granting a NON-IMMIGRANT visa outside the Kingdom of Thailand:

According to getting a Non-Immigrant visa at a Thai Embassy or Consulate outside the Kingdom of Thailand, you need to have a Supporting Letter on company letterhead states the following:

Applicant has been offered a job or starts a Thai company to employ himself.
The company requests that an Applicant be given a Non-Immigrant visa so the company may apply for a work permit for the Applicant.
The company knows the Applicants to be dependable, upstanding, and law abiding and that they will respect the laws and customs of the Kingdom of Thailand.

Other required document for Non-Immigrant visa purposes:

Validity of Passport not less than six (6) months
Two to Three (2-3) Photos of 5 × 6.5 cm. (2”× 2.5”), full faced, bared-headed, black and white or color photographs taken within six (6) months prior to the date of submitting application.
A copy of the company registration, list of shareholders, and financial statements.
Other requirement depending on the Applicant’s country of passport holder.
The Applicant should apply for this visa within thirty (30) days prior to departing your country.

In applying for a Non-Immigrant visa at Thai Embassy or Thai Consulate abroad nearby Thailand, beware that some overzealous Consulate officer may ask you some question like "How do you like working in Thailand?, or How has you company treated you so far?" This is often a way to trick you into disclosing information that might indicate you are working without a permit. Be careful in how you reply and only answer questions asked.

However, we recommend the Applicant to apply a Multiple-Entry of Non-Immigrant visa, just in case there might be some problem with the work permit paperwork, then the Applicant do not need to go to the Thai Embassy/ Consulate for visa purpose again. Oftentimes, the Thai Embassy or Consulate mostly tries to encourage you to get a single-entry and may even tell you that they do not issue multiple-entry visas. They do, however, and often a patient and friendly approach will get you what you seek.
